RIGHT OF WITHDRAWAL AND RETURN OF GOODS

The Customer has the right to withdraw from a distance purchase contract within 14 days from the date of receipt of the goods, in accordance with the legislation of the Republic of Estonia and the European Union.

The Customer must notify Sbaza OÜ of their intention to withdraw from the purchase and return the goods no later than within 14 days from the date of notifying Sbaza OÜ of the contract withdrawal.

A refund will be issued after the returned goods have been received and their condition has been inspected.

AGE RESTRICTIONS

The sale of goods in the online store sexbaza.eu is carried out exclusively to persons who have reached the age of full legal capacity in accordance with the laws of the Customer’s country of residence.

By placing an order in the online store sexbaza.eu, the Customer confirms that they are at least 18 years old or have reached the age of majority established by the legislation of their country.

Sbaza OÜ reserves the right to refuse to process an order or request confirmation of the Customer’s age if necessary to comply with legal requirements.

The Customer is responsible for the accuracy of the information provided when placing an order.

LIMITATIONS ON THE RIGHT OF RETURN

The right of withdrawal does not apply to goods that, due to their nature, cannot be returned for reasons related to health protection, hygiene, or personal use, if their original packaging, protective film, or seal has been damaged or opened after delivery.

Such goods may include:

• intimate products and personal-use items;
• goods intended for contact with the body;
• goods supplied in sealed packaging if the packaging has been opened after delivery;
• goods that cannot be resold for hygiene reasons.

A return is only possible if the following conditions are met:

• the product has not been used;
• the product is in its original and undamaged packaging;
• protective elements, seals, and packaging remain intact;
• the product retains its original appearance and is suitable for resale.

Products showing signs of use, damaged packaging, or broken protective elements will not be accepted for return where the restriction is based on hygiene and safety requirements.

RETURN COSTS

If the Customer exercises their right of withdrawal, the costs of returning the goods shall be borne by the Customer unless otherwise provided by applicable law.

After receiving the returned goods and confirming compliance with the return conditions, Sbaza OÜ shall refund the Customer for the cost of the goods within the period prescribed by law.

The refund will be made using the same payment method that was used for the original purchase, unless otherwise agreed by the parties.

LIABILITY

Sbaza OÜ and the Customer shall be liable for any damage caused to the other party as a result of a breach of these Terms of Sale, in accordance with the procedure and extent provided by the legislation of the Republic of Estonia.

Sbaza OÜ shall not be liable for defects or damage to goods resulting from:

• improper use of the product;
• failure to follow operating instructions;
• improper storage of the product;
• actions taken by the Customer after receiving the goods.

FORCE MAJEURE

Sbaza OÜ shall not be liable for delays in fulfilling obligations or for the inability to perform obligations if such circumstances are caused by events beyond the company’s reasonable control or events that could not have been reasonably foreseen.

Such circumstances may include:

• disruptions in the operation of transport companies;
• technical failures;
• natural events;
• actions of government authorities;
• other circumstances beyond the parties’ control.
